Effective date: October 20, 2026 · Version: 11
Scope. These Terms of Use (“Terms”) apply to N78-Ops (“the App”) on Android (the Android app store) and iOS (the Apple App Store), including the Basic, Pro, and Premier tiers where offered on each platform.
1. Agreement
These Terms are a legal agreement between you and Nivo78 Mobile Apps, LLC (“we,” “us”) for N78-Ops on Android (the Android app store) and iOS (the Apple App Store), for each store listing that is live when you install. By installing or using the App, you accept these Terms and our Privacy Policy. If you do not agree, do not use the App.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you control for organizing your own solo-operator business work. You may not reverse engineer, resell, redistribute, or sublicense the App except where applicable law forbids that restriction.
3. Front-end tool; accounting software is the single source of truth
N78-Ops is a front-end operations tool for organizing field work, quotes, scheduling, and customer handoffs. It is not an accounting system, a general ledger, or a bookkeeping service. Whatever accounting software you use (for example QuickBooks) is your system of record and the single source of truth for your books, balances, invoices, payments, and tax figures. N78-Ops only helps you capture and hand off clean data to that software; if the App and your accounting software ever disagree, your accounting software is authoritative. Reconcile, issue formal invoices, and file from your accounting software, not from N78-Ops.
4. Job-status transition limits (GAAP-oriented)
The App restricts which job statuses can change into which others so field records stay aligned with sound accounting practice: completion locks the service/completion date used for revenue recognition; paid-in-full and declined jobs stay closed historical records; and you cannot rewrite invoice or payment history by flipping a status. Corrections use explicit refund, returned-payment (NSF), or bad-debt actions that map to proper accounting documents—not silent status edits. The allowed/blocked transition matrix and a short explanation appear in in-app Help under Job status & ledger guardrails and in the public support center on nivo78.com.
5. Not professional advice, taxes, and store independence
Not professional advice. N78-Ops is a software tool to help you organize business records. It is not legal, accounting, tax, or financial advice.
Store and portal independence. N78-Ops is not affiliated with, endorsed by, or sponsored by Google LLC, Apple Inc., Microsoft Corporation, Intuit Inc. / QuickBooks, or other store or accounting portals.
Your tax responsibility. You enter tax rates and business data in the App. The App may calculate display lines from rules you configure, but you are solely responsible for all taxes and related obligations—including sales and use tax, income tax, payroll tax, estimated payments, filings, remittances, penalties, and any other tax or regulatory requirements. We do not prepare, file, or remit taxes for you.
6. Your data, backups, recovery key, and document delivery
Data stays on your device. Working business data stays on this device unless you back it up, export a file, send email or text handoffs you choose, enable optional hosted quote and invoice links in email (off by default) and send while online, or purchase a subscription through the platform store (Android app store billing on Android; Apple In-App Purchase on iOS where offered). You are responsible for passwords, device security, and copies you export or share. See the Privacy Policy for detail.
Backups and recovery key. Full portable backups are verified Bkp_*.zip archives in the App’s backup hub (documents/N78-Ops locked storage). Password-protected backups store an AES-256-GCM encrypted snapshot inside the ZIP using the master password you set in the App; plain backups store a readable JSON snapshot inside the ZIP. Standalone plain Bkp_*.json files are no longer created. When you set a master password, the App shows a one-time recovery key. Store it off this device. The recovery key lets you set a new master password if you forget; it does not reveal the old password and does not open old password-protected files. There is no email, phone, or support reset. Client spreadsheet CSV exports cannot restore the App—only full backups can. Pro and Premier Secure storage sealed entries are not included in portable backups—unlock Settings → Secure → Secure storage and Copy each sealed value before a phone swap.
Quote, invoice, and receipt delivery. When you email a quote, invoice, or receipt and Hosted quote and invoice links in email is enabled under Settings (off by default), the App uploads a formatted HTML view of that quote, invoice, or receipt to infrastructure operated by Nivo78 Mobile Apps, LLC on nivo78.com with limited operational metadata. Hosted documents are removed from the host after the expiration period (default 30 days) or when revoked. If offline or upload fails, the App builds a PDF on your device without uploading to Nivo78 servers.
No data broker sales. We do not sell your personal or business data to data brokers. We do not use your information for third-party advertising or behavioral ad profiling. The App does not read advertising identifiers.
7. GPS mileage and location (Pro and Premier)
Premier automatic — why Always / all-the-time. This optional feature is Premier only and only when Settings → Mileage options → Start tracking is Automatic (vehicle Bluetooth). It exists so GPS mileage can start when the saved work vehicle connects while N78-Ops is not open. iOS and Android block that background start with foreground-only location. On iPhone the work vehicle is the Bluetooth name(s) entered on that screen. On Android it is a paired device. GPS starts only when Schedule shows a work-related drive for that time. Personal drives do not start GPS. Location is used solely to measure trip distance on the device. It is not uploaded to Nivo78 and is not used for advertising. Mileage logs are not tax, accounting, or legal advice. GPS stops when the vehicle disconnects, tracking is stopped, Automatic is turned off, or after Stopped timeout when the vehicle link stays up while parked (see Help). If Always or all-the-time is denied, automatic background start is disabled. Typed miles and manual GPS remain available on plans that include them.
See the Privacy Policy, Mileage tracking by plan help article, and How your data is protected for plan-specific behavior and permission settings.
8. Payments and subscription tiers
Customer job payments. Customer job payments and card details are handled outside the App with tools you choose (cash, check, card reader, payment link, etc.). We do not collect or process your customers’ payment card numbers inside N78-Ops.
Basic tier. The Basic plan is free forever and does not require a subscription.
Pro and Premier tiers. Pro and Premier are optional annual paid upgrades. Android app store billing on Android and Apple In-App Purchase on iOS may process annual in-app subscriptions where offered on that platform. Platform store policies apply to that checkout. We do not receive your full payment card number from the app store or Apple.
Renewal. Pro and Premier subscriptions renew annually unless canceled at least 24 hours before the end of the current period. The price is shown in the App before purchase. On iOS, manage or cancel in Apple ID Account Settings. On Android, manage or cancel in the Android app store subscription settings.
9. Disclaimer, real business data, and limitation of liability
Provided as-is; your risk. The App is provided “as is” and “as available,” without warranties of any kind. Your use of N78-Ops and any decisions you make based on information in the App are at your own risk.
Real business data. If you use the App with live clients, quotes, and financial records, you are responsible for accuracy, backups, device security, and verifying totals before you rely on them or send them to customers.
Limitation of liability. To the fullest extent permitted by law, Nivo78 Mobile Apps, LLC is not liable for data loss (including lost or corrupted business records, failed backups, or device problems), business losses, income or revenue losses, tax outcomes, missed deadlines, or other harm arising from your use of the App, except where applicable law requires otherwise.
10. Privacy summary, retention, deletion, and acceptance record
Our Privacy Policy describes what stays on device, what optional hosted links upload (and their 30-day retention before being removed from the host), clipboard auto-clear after about one minute for copied sealed vault values, and what the legal acceptance record stores (disclosure version, acceptance time, app version) in private on-device app storage.
Data deletion. On-device business records are removed by deleting them in the App, using multi-step factory reset (requiring your master password when configured), or uninstalling. To request deletion of data we may hold from optional hosted view links or prior support communications, email support@nivo78.com.
11. Acceptance and changes
Before you use core workflows, the App requires explicit acceptance of the in-app Legal & Privacy disclosures. When disclosure version changes materially, the App re-prompts for acceptance. We may update these Terms from time to time. Current Terms are published at https://nivo78.github.io/N78-Public-Legal/pages/N78-Ops.terms.html and in the in-app Legal & Privacy gate. Continued use of the App after changes means you accept the updated Terms.
