This Operator Responsibility Disclaimer is part of the legal package for N78-Machining alongside the Privacy Policy and Terms of Use. If you do not agree, do not use the app.

The job: Speeds and feeds calculator, CNC tooling database, thread and drill charts, material library, and shop job records.

1. Software is a tool — not a substitute for professional judgment

N78-Machining is local-first software that helps you organize work on your device. It is not legal, tax, accounting, engineering, safety, medical, or other licensed professional advice. Calculations, defaults, templates, and suggestions are starting points only.

2. You remain solely responsible for outcomes

You — not Nivo78 Mobile Apps, LLC — are solely responsible for verifying inputs, reviewing outputs, backups, exports, customer communications, regulatory compliance, and every real-world outcome before you rely on the app or act on its results.

2a. The Professional Machinist Standard (machining-specific)

Just as a craftsman looking up speeds and feeds in Machinery’s Handbook or measuring with a digital micrometer remains 100% solely responsible for checking tool clearances, part zero, and workholding rigidity before cutting, the operator of N78-Machining retains sole responsibility for all machine setups and cut outcomes. A reference calculator provides starting baselines; the operator commands the spindle.

N78-Machining is a digital calculation utility, engineering reference, and shop organizational aid. Speeds, feeds, horsepower estimates, tap drill recommendations, canned cycles, and G-code snippets are mathematical approximations and reference starting points only — not certified machining programs.

The operator, programmer, and machinist bear 100% sole responsibility for verifying cutting parameters, spindle RPM, feed rates, chip loads, stepovers, depths of cut, tool stickout, clearances, workholding, coolant delivery, and G-code programs before cycling any CNC machine, manual mill, lathe, or cutting any material.

2b. Shop Calculation Record and export scope

An exported Shop Calculation Record is a tamper-evident digest of in-app license metadata and referenced calculation capabilities only. It is not AS9100, ISO 9001, ITAR, EAR, or NIST certification; not third-party audit evidence; and not a substitute for your quality system, export-compliance program, or machine setup verification. Nivo78 does not certify your shop, processes, or parts.

N78-Machining is designed for local-first, air-gapped use with no product telemetry on vault or job data. Your organization — not Nivo78 — is solely responsible for ITAR, EAR, export controls, defense/security policies, and determining whether this software is appropriate for a given facility or contract.

3. No warranty on real-world results

To the maximum extent permitted by law, Nivo78 does not warrant that the app will be error-free, uninterrupted, or fit for a particular regulated or safety-critical use case without your independent verification.

CONSPICUOUS WARRANTY DISCLAIMER (UCC § 2-316 WHERE APPLICABLE)

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIVO78 MOBILE APPS, LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIVO78 MOBILE APPS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY ARISING FROM USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY. LIABILITY CAP: IN NO EVENT WILL NIVO78 MOBILE APPS, LLC’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE APP OR THESE LEGAL TERMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50.00).

Governing law: These legal terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.

Venue: Any dispute arising out of or relating to the App or these legal terms shall be brought exclusively in the state or federal courts located in Smith County, Texas, and each party consents to personal jurisdiction and venue in those courts, except where applicable law requires otherwise.

Severability: If any provision is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

Entire agreement (merger): The Operator Responsibility Disclaimer, Terms of Use, and Privacy Policy (each as published for this product on N78-Public-Legal) constitute the entire agreement between you and Nivo78 Mobile Apps, LLC regarding the App and supersede prior or contemporaneous understandings on that subject, except for additional terms imposed by the applicable app store or platform.

You remain solely responsible for legal compliance, tax filings, regulatory obligations, and professional decisions.
